In her recent essay “Affirming Affirmative Action By Affirming White Privilege: SFFA v. Harvard” for the Georgetown Law Journal, Jeena Shah questions the district court’s assessment of Harvard’s use of race-based affirmative action, arguing that a footnote on the issue of discrimination against Asian- American applicants as a result of race-neutral components of the admissions program should have served as the central basis of the court’s ruling.
