This CLE will provide an overview of the rights of those incarcerated as well as possible remedies when those rights are violated including the use of Section 1983, the federal disability statutes, and New York law, as well as their limitations. This will include a discussion on solitary confinement as well as the unique concerns surrounding those incarcerated who are transgender and gender non-confirming and those living with a disability.
